Marangoni é o autor da proposta
O Projeto de Lei 51/23, do deputado Marangoni (União-SP), permite que o advogado defenda seu cliente pessoalmente em recursos contra decisões de um único juiz que impedem o Superior Tribunal de Justiça (STJ) de analisar o processo.
A proposta tramita na Câmara dos Deputados e altera o Estatuto da Advocacia (Lei 8.906/94). Atualmente, o advogado pode fazer sustentação oral em outros tipos de recurso, como em casos de mandado de segurança.
Segundo Marangoni, o objetivo do projeto é corrigir a falta de previsão legal para que o advogado possa falar também nesses tipos de recurso.
Próximos passos
A proposta será analisada, em caráter conclusivo, pela Comissão de Constituição e Justiça e de Cidadania.
Para virar lei, a proposta precisa ser aprovada pela Câmara e pelo Senado.
